From Newspapers
Exeter & Plymouth Gazette Tuesday 25 October 1898
At Teignmouth Petty Sessions yesterday, before Mr J.R. Gulson, the Rev Anson Cartwright, Col R.J. Morrison, Col C.W. Nightingale, and Mr. M.L. Brown
Mr G.H. Furler applied for an ejectment order against Mrs Heal, the occupier of the Bird in Hand Inn.
Mr W.J. Watts of Newton, acted as Magistrate's clerk
Mr J. Beal (Exeter) appeared for the applicant and Mr I. Carter (Torquay) for Mrs Heal
From the evidence it appears that the property was originally owned by a Mr Hutchings. On his death he left it to his sister, who died intestate, and the property fell by right into the hands of Mr G.H. Easterling who, by deed of gift, conveyed it to his son, Mr J. Easterling. He appointed Mr G.H. Furler as his agent to collect the rents, and he eventually leased the property from Mr J. Easterling
The usual notices to quit were served, which Mr Beal proved.
The contention on the part of Mr Carter was that the notice that was made out in the names of two persons was only signed by one; and secondly, in the notice of application for ejectment John Easterling was called James. This, Mr Carter contended was bad and fatal to the legallity of the notice.
After considerable argument on both sides the bench ruled that they had nothing before them to show authoritively that the notices were invalid, and made an order to give up possesion in 27 days. The case lasted nearly two hours.
Western Times, Tuesday 17 January 1899
At Newton County Court on Friday before his Honour Judge Woodfall, Elizabeth Heal, landlady of the Bird In Hand Inn, Teignmouth, claimed £50 from George Henry Furler, for that defendant, being the agent of George Henry Easterling and of John Henry Easterling, obtained from the Justices sitting in Petty Sessions at Teignmouth a warrant for the ejectment of plaintiff from Bird in Hand Inn, the defendant at that time not being entitled to the possesion of the said premises.
Mr Howland Roberts, barrister of the Western Circuit (instructed by Messes Carter and Carter), appeared for plaintiff; Mr D Metcalf, barrister of the Western Circuit, for the defendant.
Mr Roberts said the plaintiff's predecessor, her husband, John Heal, was the original tenant, and he remained the tenant until the demise of Mr John Hutchings, in the year 1874, and the defendant, George Henry Furler, now claimed that he was agent of Mr Hutchings successors. The main point of the action was, shortly, whether Mrs Heal's tenancy of the Inn was duly determined by legal notice to quit.
It had been held under the third section of the Small Tenement Recovery Act, which provided that the obtaining of an order against a tenant where a landlord had no right to obtain, was a trespass, and that an action might be brought in the County Court based upon that trespass, although the warrant had not been duly executed.
Mr Roberts then went into the nature of the agreement and the alleged trepass. Mrs Heal bore out her advocate's statement, and said she received a notice on the 13th of October, and on the 24th went before the magistrates. The order was made aginst her and she instructed her solicitors to question it. On the 10th of December she received a letter from Furler and was ejected the same day.
Mr Frank Heal, plaintiff's son, Mr A E Dunn also gave evidence. The other witnesses in the case were George Henry Easterling, Mr Furler and P S Richards.
His Honour gave judgement for Plainfiff for the amount claimed £50 and costs, and remarked that if the plaintiff had claimed more she would have had it.
Western Times - Saturday 9 December 1843
Exeter Police
A boy named George Easterling with his father and mother, were charged with an assault on John Eveleigh. The complainant having heard on Sunday afternoon that some boys were fighting a cock, which he kept, in Horsepool Lane, went to the spot and found two boys named Rowe and Sayers, setting two cocks to fight, of which one was his. He collard Rowe, and in consequence of what he told him, went to Easterlings, and charged him with having set the cocks fighting. Easterling called him a liar, compainant persisted in coming into the house, and Easterling pushed him back. A scuffle ensued in which compainant got thrown down. Easterling's father, an infirm old man, and his mother came to his assistance, and Eveleigh got the worst of it, receiving a kick in the face from his juvenile opponent.
The Bench fined the boy 2s 6d.
Exeter and Plymouth Gazette - Saturday 9 December 1843
James, George and Jemima Easterling, being father, mother and son, were charged by John Evelyn with an assault on Saturday afternoonm . The complainant kept a game cock, which was taken from his premises on that afternoon to fight another, as he was informed, at the instigation of the junior Easterling. He was called by a neighbour to stop the iniquitous proceedings and found the fight had ceased without the defendant being present. Seeing, however, that the other cock was put into Easterling's house, he knocked at the door, which was opened by the mother, and asked if her son had been engaged in the transaction. The son, who was upstairs, overheard the question, came down in a great passion and struck the complainant. The father and mother then pulled him towards the stairs and held him whilst the son kicked him, the marks of which he bore upon his visage.
Young Easterling then offered to fight him in the street, which he refused. The defendant denied the truth of this staement:- the father stated that he was upstairs reading the bible, and therefore not likely to get into a row of a Sunday: whilst the mother admitted that her son did push Evelyn and might have kicked him, but denied the other parts, and said that her son was "dressing" and had not been cock fighting at all. The father and mother were discgarged, but the son was fined 2s 6d and expenses.
